I pass this along letter on the census for your information, only. I do not
counsel anyone. Of course, A direct and literal reading of the U.S. Constitution
it seems to me, a non lawyer, is clear as to what the law is: people are legally
obligated, only, to cooperate in a head count for political representation
purposes.
My response to the Census
I compiled this letter and inserted it into the Census envelope, along with
my 2010 census form.

To Whom it May Concern,
Pursuant to Article I, Section 2, Clause 3 of the Constitution, the only information
you are empowered to request is the total number of occupants at this address.
My name, sex, age, date of birth, race, ethnicity, telephone number,
relationship and housing tenure have absolutely nothing to do with apportioning
direct taxes or determining the number of representatives in the House of
Representatives. Therefore, neither Congress nor the Census Bureau have the
constitutional authority to make that information request a component of the
enumeration outlined in Article I, Section 2, Clause 3. In addition, I cannot
be subject to a fine for basing my conduct on the Constitution because that
document trumps laws passed by Congress.
Interstate Commerce Commission v. Brimson, 154 U.S. 447, 479 (May 26, 1894)
Neither branch of the legislative department [House of Representatives
or Senate], still less any merely administrative body [such as the Census
Bureau], established by congress, possesses, or can be invested with, a general
power of making inquiry into the private affairs of the citizen. Kilbourn
v. Thompson, 103 U.S. 168, 190. We said in Boyd v. U.S., 116 U. S. 616, 630,
6 Sup. Ct. 524,--and it cannot be too often repeated,--that the principles
that embody the essence of constitutional liberty and security forbid all
invasions on the part of government and its employees of the sanctity
of a mans home and the privacies of his life. As said by Mr. Justice
Field in Re Pacific Ry. Commission, 32 Fed. 241, 250, of all the rights
of the citizen, few are of greater importance or more essential to his peace
and happiness than the right of personal security, and that involves, not
merely protection of his person from assault, but exemption of his private
affairs, books, and papers from inspection and scrutiny of others. Without
the enjoyment of this right, all others would lose half their value.
Note: This United States Supreme Court case has never been overturned.

Facts:
1) The Census has been hijiacked by the executive, under the direct control
of Mr. Obama.
Title 13 of the U.S. Code, Chapter 1, Subchapter I, § 2, entitled Bureau
of the Census, states: The Bureau is continued as an agency within,
and under the jurisdiction of, the Department of Commerce. Not under
the jurisdiction of Obama and Rahm Emanuel, but the Department of Commerce.

2) Article I, Section 2 of the US Constitution gives Congress the right to
ENUMERATE the number of citizens in order to apportion members of congress:
"The actual Enumeration shall be made within three years after the first
meeting of the Congress of the United States, and within every subsequent
term of ten years, in such manner as they shall by law direct." Enumerate
means "to count, or determine the number of". Congress can COUNT
the number of citizens- but it can't demand to know what race we are, how
much we earn, how many big screen TVs we own, or similar.
So when I get the census forms, I fill out the first question (the one asking
how many people live at my home), then paste a copy of Article 1, Section
2 of the Constitution right below that, along with a statement that I have
fulfilled my duty as a citizen by helping them enumerate, and I'm not required
to answer any more questions.
Bottom line: I Gianluca Zanna, and many other Mohave County Residents we will
refuse to comply with the unconstitutional and invasive questionary of 11
pages of the census 2010. The only answer we owe according to the Constitution
is to answer "how many people live in the house".
If the census agent after I have provided the count of how many people live
in my household, he/she or they will continue in harrassing me or my family
I will dial 911 and press charges for harrassment, transpassing on private

§ 241.
Conspiracy against rights
If two or more persons conspire to injure, oppress, threaten, or intimidate
any inhabitant of any State, Territory, or District in the free exercise or
enjoyment of any right or privilege secured to him by the Constitution or
laws of the United States, or because of his having so exercised the same;
or
If two or more persons go in disguise on the highway, or on the premises of
another, with intent to prevent or hinder his free exercise or enjoyment of
any right or privilege so secured -
They shall be fined not more than $10,000 or imprisoned not more than ten
years, or both; and if death results, they shall be subject to imprisonment
for any term of years or for life.
§ 242.
Deprivation of rights under color of law
Whoever, under color of any law, statute, ordinance, regulation, or custom,
willfully subjects any inhabitant of any State, Territory, or District to
the deprivation of any rights, privileges, or immunities secured or protected
by the Constitution or laws of the United States, or to different punishments,
pains, or penalties, on account of such inhabitant being an alien, or by reason
of his color, or race, than are prescribed for the punishment of citizens,
shall be fined not more than $1,000 or imprisoned not more than one year,
or both; and if bodily injury results shall be fined under this title or imprisoned
not more than ten years, or both; and if death results shall be subject to
imprisonment for any term of years or for life.
Please
Sheriff Sheahan, warn your deputies about these potentially coming phone calls
in case cited above and remind your deputies about our Constitutional rights
(like the 4th and 5th amendment).
More facts for our elected officials...
Our nations Constitution provides for a head count every ten years to ensure
all Americans are properly represented. However, after looking at the upcoming
questions presented in the Questions Planned for the 2010 Census and
American Community Survey found at http://2010.census.gov/2010census/
pdf/2010ACSnotebook.pdf you will verify that
The Constitution quite explicitly dictates in Article 1, Section 2, as well
as in the modification found in the 14th Amendment, that the purpose of the
Census is to help apportion direct taxes and Representatives. I can think
of no reason why the government needs to know anything more than the number
of people in a home.
I strongly believe the ninth and tenth amendments provide for the protection
of the citizens of Arizona from an intrusive Federal Government.
Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed
to deny or disparage others retained by the people.
I believe I retain the right to be secure in my home, that the contents therein
are protected unless I am suspected of performing some act or action which
could be harmful to others, in which case a warrant would be required, not
a Census, there is no valid reason why I need to provide any other data for
the Census.
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited
by it to the states, are reserved to the states respectively, or to the people.
The Constitution requires a Census every ten years for the purpose of determining
representation ONLY, I can find no other need in the US Constitution for conducting
a Census. Therefore, there is nothing else that can or should be added to
the Census other than a head count of LEGAL Americans. The power to count
the people is clearly given to the Congress, the power to count or track anything
else is not.
I am certain that you are aware of precedent in the matter of States resolving
to ignore a Federal mandate due to Constitutional concerns The Virginia
and Kentucky Resolutions of 1798. In these Resolutions each respective state
drafted it in defiance of the Aliens and Seditions Act.

We respectfully request the State of Arizona and the Mohave County Sheriff
and his deputies to protect our property and Constitutional rights, our families
from fines and redress regarding all unnecessary and uncostitutional questions
pertaining to the 2010 Census.
