Gun Registration at the MVD
in Kingman Arizona??!!

MVD Kingman: we exposed and stopped the Gun Registration!!
June 2nd 2011 MVD in Kingman AZ
around 3:00 pm

Just less than 48 hours ago the MVD in Kingman was collecting the data of my gun to send to Phoenix MVD headquarter... Allegedly in violation of the ARS 13-3108
see the story at the bottom of the page

After few emails and few calls to our State Legislators, things have changed... for the better. Immediately.

Finally MVD has ceased immediately in keeping records of guns and their owners that check them at their offices.

This is Arizona!!! People have still Rights...
Unelected Burocrats CANNOT rewrite or ignore our State Laws!!

All tyranny needs to gain a foothold is for people of good conscience to remain silent.

Is the Kingman MVD breaking the law ARS 13-3108
and doing illegal gun registration?

by Gianluca Zanna

May 31st 2011 Kingman AZ
around 4:30 pm

Today I went to the local MVD in Kingman to register a car. I see the sign No Guns Allowed in the building.
I comply of course, and I ask politely to the clerk I need to check my gun in the safe box.
The clerk politely shows me the safe box, but surprise... she asks me for my Driver license number that MUST be written in the MVD database log along with the description of my gun.
Of course the MVD keeps the record. I try to explain the ARS 13-3108 to a supervisor, but the supervisor of the MVD tells me that they have a policy from Phoenix and what they are doing is right. I politely comply, but I tell him that I will investigate further in to this matter.
I find lately, reading the MVD policy, that the log database must be faxed to Phoenix.
Why? Is this a violation of the ARS 13-3108?

ARS 13-3108
C. A political subdivision of this state shall not require or maintain a record in any form, whether permanent or temporary, including a list, log or database, of any of the following:

1. Any identifying information of a person who leaves a weapon in temporary storage at any public establishment or public event, except that the operator of the establishment or the sponsor of the event may require that a person provide a government issued identification or a reasonable copy of a government issued identification for the purpose of establishing ownership of the weapon. The operator or sponsor shall store any provided identification with the weapon and shall return the identification to the person when the weapon is retrieved.
The operator or sponsor shall not retain records or copies of any identification provided pursuant to this paragraph after the weapon is retrieved.

Then read their "policy" that seems to me to be infringing our State law.

"The attendant will initial the log to indicate that the individual has retrieved their weapon and the returned the key. Log sheets, with or without entries, are to be faxed to MVD Facilities Manager at 602-712-3081 no later than the 5th of every month"
